Los Angeles man David Pearce is asking the judge to lower bail and release him on rape charges

A Los Angeles man arrested in the deaths of a model and her friend has asked a judge to reduce his $3.4 million bail and let him walk free while he fights unrelated rape allegations .

In court documents filed this week, defense attorney Jacob Glucksman said prosecutors brought “old” rape allegations against Pearce in order to keep his client in jail while investigators continue to gather information linking Pearce to the deaths of model Christy Giles and to the architect Hilda Marcela Cabrales by overdose. Pearce is asking the judge to lower his bail to $100,000 and said he is willing to wear a GPS ankle monitor.

“This case attracted media attention because of the very unfortunate deaths of two women who appeared to have died of a drug overdose on or about November 2021,” Glucksman wrote in the filing. “The descendants died after apparently having contact with the accused. However, the court should note that Mr Pearce has not been charged with any crime in connection with this unfortunate incident.

“People appear to have ‘dusted’ old files against Mr Pearce and in return filed very serious criminal offenses against him, which include the possibility of a life sentence, in order to keep Mr Pearce incarcerated while they continue to investigate the death of Women.

“The defense is not arguing that the people cannot do this, but the bail should be commensurate with the alleged offenses and not questions that are pure speculation and media fodder at this time.”

Pearce, 37, was arrested in December in the deaths of the two women but two days later was charged with multiple counts of rape and sexual assault.

The LAPD also arrested two other men, Brandt Osborn, 42, and Michael Ansbach, 47, who were also with Pearce and the two women at a camp party in Los Angeles on November 13.

Homicide investigators said two masked men driving an unlicensed Toyota Prius dumped Giles’ lifeless body at a Culver City hospital. The men also dropped Cabrales-Arzola at Kaiser Permanente in West LA. Cabrales-Arzola did not wake from her coma and died on November 24.

In the bail application, Glucksman said Pearce works as a freelance entertainment events planner and lives paycheck to paycheck, so he cannot afford the bare minimum to post the $3.4 million bail related to the rape allegations numbers.

He also said it was dangerous to keep Pearce in prison during the COVID surge as Pearce was suffering from pre-existing health conditions. Glucksman added that his client needs medication for his various mental illnesses and hasn’t had access to them in over a month.

Prosecutors say Pearce sexually assaulted a woman in 2010, raped another woman in 2019, and raped two other women in February and October 2020.

Addressing the rape allegations in the filing, Glucksman said the alleged 2010 incident was only reported last year “when the plaintiff witness saw something on Instagram that triggered her memory,” while the 2019 allegation was made by a woman, who does not live in the US and was only reported in November.

“Counts 3 and 4 relate to felonies allegedly committed in 2020 that were denied by prosecutors due to evidence issues,” Glucksman wrote in the filing.

“Indeed, a complaining witness was recently interviewed and reiterated that her memory of the alleged incident was ‘vague’. Furthermore, there is little, if any, forensic evidence linking the defendant to these ancient alleged incidents, and in at least one alleged incident the compliant witness admittedly had consensual sex with the defendant.”

Giles’ husband Jan Chillers told The Post that while it was difficult to remain patient, he was told detectives were continuing their investigation into the deaths of his wife and Cabrales-Arzola.

“Honestly, the biggest frustration is that they still haven’t filed any charges against any of these guys for what happened to my wife and her friend,” Chillers said. “The only consolation prize is that David is off the streets and still locked up where he can’t hurt anyone.”

Osborn and Ansbach, who were also arrested in December, were released. No charges were brought against the two men.

Meanwhile, Pearce will present his motion for a reduced bail bond before a Los Angeles judge on Monday.
